These terms cover what you can expect from us, what we expect from you, and what happens if something goes sideways. We've kept it short on purpose. If anything's unclear, just ask — we'll always say what we mean.
01About these terms
By using our website or hiring us for a project, you're agreeing to these terms. They form a binding agreement between you ("you," "the client") and VeryClear Marketing, a sole proprietorship operated by Rustin Witt out of Milwaukee, Wisconsin ("we," "us," "our").
02The free mockup
When you submit your URL through our website, we'll send you a free homepage mockup within 24 hours. This is genuinely free. You don't owe us anything for it, and you're under no obligation to hire us afterward. We may decline to produce a free mockup if your project falls outside our typical scope (e-commerce, custom platforms, etc.) — in that case, we'll let you know quickly so you don't wait around.
The mockup itself is created by us using our own design judgment based on your existing site. If you don't hire us, you don't have a license to use the mockup — it remains our intellectual property until a project is engaged and paid in full.
03What's included in a project
Our standard $2,497 flat-fee website redesign includes:
- A custom-designed homepage
- Up to five additional inner pages
- Mobile-responsive design
- A working contact form
- Light copy refinement (rewriting and tightening existing text)
- Basic on-page SEO setup (meta tags, semantic HTML, fast load times)
- Hosting setup and launch
- Domain and DNS handling
- 301 redirects from your old site URLs
- A plain-English handoff document
- Phone and video support throughout the project
- 14 days of post-launch tweaks at no additional charge
What's not included unless agreed in advance: full copywriting, photography, illustration, custom integrations, e-commerce functionality, membership systems, blog migration, or third-party software costs (like premium WordPress themes, Webflow plans, or Shopify subscriptions).
04Timeline
We aim to deliver your full website within three business days of project kickoff. The clock starts the morning after you've signed the agreement, paid the deposit, and provided all required content (existing copy, logos, images, and access to your domain). If those things come in late, the timeline shifts accordingly.
The 3-day timeline assumes the project fits within standard scope. If you have a more complex site, we'll quote a custom timeline up front.
05Payment
The total project fee is split 50% on signing, 50% on launch:
- 50% deposit is due upon signing the project agreement. Work begins once the deposit clears.
- 50% balance is due upon launch — when your new site is live on your domain.
We accept payment by ACH bank transfer, credit card, or check. Late payments may incur a 1.5% monthly finance charge. If a balance is more than 30 days past due, we reserve the right to take the new site offline until payment is received.
Hosting fees, domain registration fees, and any third-party software subscriptions are billed by those providers directly to you, not by us.
06Revisions
Our flat-fee project includes two rounds of revisions on the homepage and one round on each inner page. Revisions are about refining direction (typography, color, layout, copy adjustments) within the design we've delivered. Major direction changes — like "let's start over with a different style" — are outside the scope of standard revisions and may require a separate quote.
Revision rounds need to be requested within seven days of delivery to keep the project moving. Additional revision rounds beyond what's included are billed at $150/hour.
07Post-launch tweaks
For 14 days after your site goes live, we'll handle small fixes at no charge — typo corrections, minor copy edits, image swaps, broken-link fixes. Anything substantive (new pages, new features, redesigning existing pages) falls outside this window and is billed separately.
After 14 days, ongoing maintenance, content updates, or new feature work can be handled on a monthly retainer ($200–$500/month depending on volume) or billed per-project.
08Cancellation and refunds
Before work begins: If you change your mind before we've started designing — meaning before we've delivered the first homepage draft — your deposit is fully refundable. Just email us.
After work has started: Once we've delivered the first homepage draft, the deposit is non-refundable. We've already done the work. If you cancel mid-project, no further payment is due, but you don't have rights to use the partial work.
If we cancel: If for any reason we can't complete your project (illness, scheduling conflict, scope mismatch we discover too late), we'll refund any unused portion of your deposit and help you find a suitable alternative if you want.
09Intellectual property
Once your project is paid in full, you own the final deliverables — the design, the code, and any content we wrote for you. You can keep them, modify them, or move them to another developer at any time. We retain the right to display the work in our portfolio and case studies unless you specifically ask us not to.
Any third-party assets used in your project (stock photography, fonts, plugins) are licensed to you under the terms set by their original creators. We'll let you know what those terms are at handoff.
We retain ownership of any underlying systems, code patterns, or templates we develop in the course of doing business — we may use them for other clients. What's yours is the specific creative output of your project.
10Your responsibilities
To keep your project on track, you agree to:
- Provide accurate information about your business, audience, and goals
- Deliver content (text, images, logos) on time and in usable formats
- Provide timely access to your domain registrar, hosting account, or any other accounts we need
- Respond to our messages within one business day during the active project
- Make sure you have the legal right to use any content you give us (no copyrighted material you don't own)
- Pay invoices on time
11Limitation of liability
We do our best work for every client, but websites are complex and the internet is unpredictable. To the maximum extent permitted by Wisconsin law, our total liability for any claim related to a project is limited to the total amount you've paid us for that project. We're not liable for indirect or consequential damages — like lost revenue, lost customers, or business interruption — even if we've been advised that such damages are possible.
We don't guarantee specific business outcomes. A new website is a tool, not a magic bullet — your sales depend on a lot of factors we don't control.
12Confidentiality
Anything you share with us about your business that's not publicly available — financials, strategy, customer lists, internal documents — we treat as confidential. We won't share it with anyone outside our project work for you. This obligation continues after the project ends.
13Governing law and disputes
These terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law principles. Any dispute that can't be resolved through direct conversation will be handled in the state or federal courts located in Waukesha County, Wisconsin.
Before pursuing legal action, both parties agree to make a good-faith effort to resolve the dispute through direct discussion or, if needed, mediation. We'd much rather pick up the phone than send a lawyer's letter.
14Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. For active clients, we'll communicate any changes that affect ongoing projects directly. By using our website or services after changes are posted, you accept the updated terms.
15Severability
If any part of these terms is found to be unenforceable, the rest of the terms still apply. The unenforceable part will be interpreted to come as close to its original intent as legally possible.
16Questions
